By accessing or using our services, you agree to these Terms and Conditions. If you do not agree, please do not use our services.
The services are intended for users who are at least 18 years old. Persons under 18 are not permitted to use or register for the services.
1. Our Services
Otoddy connects car owners, customers, businesses and users with professional drivers for hourly, one-way, round-trip, outstation, corporate, B2B and related driver services. Information provided through the services is not intended for distribution or use where such distribution or use would violate applicable law.
- Users remain owners or authorized users of their vehicles.
- Drivers provide professional driving services only.
- All bookings are subject to availability and verification.
- Users accessing services from other locations are responsible for local law compliance.
2. Intellectual Property Rights
We own or license intellectual property rights in the services, including software, website design, content, trademarks, logos, app features and related material. These are protected by applicable laws and are provided for personal, non-commercial use unless expressly permitted.
You may not copy, reproduce, distribute, commercially exploit, reverse engineer, modify or misuse any part of the services without written permission. For requests, contact info@otoddy.com.
3. User Representations
By using Otoddy, you represent and warrant that:
- You provide true, accurate, current and complete information.
- You will maintain and update your information when required.
- You have legal capacity and agree to comply with these terms.
- You are not a minor where you reside.
- You will not use the services for illegal or unauthorized purposes.
- You will not violate applicable laws or regulations.
If false or incomplete information is provided, we may suspend or terminate access.
4. User Registration
You may be required to register to use some services. You agree to keep your login details confidential and are responsible for all activity under your account. We may remove or change usernames, profiles or accounts that are inappropriate, offensive, misleading or violate these terms.
5. Purchases and Payment
We may accept payment methods including Visa, Mastercard, Razorpay, UPI, wallets and internet banking. Transactions are generally conducted in INR unless stated otherwise.
- You agree to provide accurate billing and payment information.
- Prices, charges and availability may change without notice.
- We may refuse or cancel bookings due to pricing errors, fraud risk or suspicious activity.
- Cancellation, refund and penalty rules may vary by booking type and operational policy.
6. Software
Software provided with the services is licensed, not sold. It may be subject to a separate EULA or app-store rules. You may not copy, modify, reverse engineer, distribute or misuse software except as permitted by law or license. Software is provided “as is” without warranty.
7. Prohibited Activities
You agree not to:
- Use automated systems to scrape, copy or collect content.
- Defraud, mislead, harass or harm other users, drivers or customers.
- Interfere with security features or service functionality.
- Upload viruses, spam, malicious code or harmful content.
- Impersonate others or use false identity information.
- Use services for unauthorized commercial, illegal or fraudulent purposes.
- Remove copyright, trademark or proprietary notices.
- Misuse booking, driver assignment, pricing or payment systems.
8. User Generated Contributions
The services may not generally offer public posting of user content. If any content, review, suggestion, image, message, rating or feedback is submitted, you remain responsible for it and must ensure it is lawful, accurate and non-offensive.
9. Contribution License
By submitting suggestions, feedback, reviews or other input regarding the services, you grant us the right to use such material for service improvement, operations, marketing or quality purposes without compensation, subject to applicable law and privacy policy.
10. Guidelines for Reviews
When leaving reviews, you agree that:
- You have firsthand experience.
- Your review is honest and not misleading.
- Your review is not offensive, discriminatory, illegal or abusive.
- You will not post false complaints or manipulate ratings.
We may moderate, remove or restrict reviews at our discretion.
11. Mobile Application License
Use of the Otoddy app is licensed, not sold. You may not reverse engineer, commercially exploit, copy or remove proprietary notices from the app. You must comply with applicable app store terms and device platform rules.
12. Services Management
We may monitor services for violations, restrict access, remove content, limit accounts, investigate complaints, hold payments or take operational/legal action to protect users, drivers, clients, vehicles, service quality and company rights.
13. Privacy Policy
Our Privacy Policy governs handling of personal information. By using the services, you consent to processing, storage and transfer of data in India as required for service delivery. Read it at https://www.otoddy.com/privacy.
14. Term and Termination
We may terminate or suspend access for any reason, including breach of these terms, false information, fraud, misconduct, unlawful activity or operational risk. Such termination does not limit our legal rights.
15. Modifications and Interruptions
We may modify, suspend, discontinue or update services at any time without notice. We are not liable for service interruptions, downtime, feature changes or unavailability.
16. Governing Law
These terms are governed by the laws of India. You agree to submit to the jurisdiction of competent courts in India, subject to applicable dispute resolution provisions.
17. Dispute Resolution
Disputes should first be resolved through informal negotiation. If unresolved, disputes may be referred to arbitration or competent courts as applicable. Claims related to intellectual property, injunctions, fraud, theft, vehicle damage, recovery or urgent relief may be taken directly to appropriate legal forums.
18. Corrections
We may correct errors, inaccuracies, omissions or outdated information in the services without prior notice.
19. Disclaimer
Services are provided “as is” and “as available”. We disclaim warranties including merchantability, fitness for a particular purpose, non-infringement, uninterrupted service, error-free operation or complete accuracy. Use of services is at your own risk.
20. Limitations of Liability
To the maximum extent permitted by law, our liability is limited to the amount paid by you to us for the relevant booking or service. We are not liable for indirect, incidental, punitive, special or consequential damages, including loss of profit, data, goodwill or opportunity.
21. Indemnification
You agree to indemnify and hold harmless Otoddy, its directors, employees, affiliates, partners and agents from claims, losses, damages, liabilities, expenses or demands arising from your use of services, breach of these terms, violation of law, or infringement of third-party rights.
22. User Data
We maintain data transmitted through services for operations and performance. You are responsible for maintaining your own backups where needed. We are not liable for loss, corruption or unauthorized access except as required by applicable law.
23. Electronic Communications, Transactions, and Signatures
Emails, SMS, app notices, website forms, digital confirmations and electronic communications satisfy legal requirements for writing and signatures. You agree to receive notices, contracts, disclosures and records electronically.
24. SMS Text Messaging
By opting into SMS or WhatsApp communication, you consent to receive booking updates, account alerts, service messages and support communication. To opt out of SMS programs, follow the instructions provided or contact support. Message and data rates may apply.
25. Miscellaneous
These terms and posted policies constitute the entire agreement between you and Otoddy. If any provision is unenforceable, the remaining provisions remain valid. Failure to enforce a right is not a waiver. We may assign our rights and are not liable for events beyond our reasonable control.

27. B2B Driver Terms & Responsibilities
This section applies to all drivers, driver partners, chauffeurs or third-party personnel assigned through Otoddy for B2B rides, corporate rides, client vehicle movement, pickup/drop services or any driver-related service. By accepting, starting, performing or completing any ride through Otoddy, the driver agrees to these driver-specific terms.
27.1 Driver Custody Responsibility
- From pickup/handover until final delivery, the vehicle remains under the complete custody, control and responsibility of the driver.
- The driver is responsible for safety, security, handling, parking, route movement and vehicle condition during the service period.
- The driver must ensure the vehicle is not misused, damaged, tampered with, illegally parked or left unattended unsafely.
27.2 Vehicle Parts, Accessories & Belongings
- The driver must protect vehicle parts, accessories, documents, tools, keys, FASTag, fuel, battery, tyres, stereo, infotainment, chargers, spare wheel, toolkit and belongings.
- If any item is missing, stolen, exchanged, damaged, replaced or tampered with, the driver may be held responsible after verification.
- Unauthorized removal, replacement, sale, exchange or misuse of vehicle parts or belongings is a serious violation.
27.3 Theft, Damage & Harzana Liability
- If found guilty of theft, damage, fraud, negligence, misuse or suspicious activity, the driver shall pay full harzana/compensation.
- Compensation may include market value, repair, replacement, service, towing, inspection, legal expenses, client claims and related losses.
- Otoddy may calculate compensation based on invoice, service center estimate, market value, client claim or internal assessment.
27.4 7-Day Post-Ride Liability
- If theft, missing part, damage, tampering, fuel discrepancy or suspicious issue is discovered within 7 days after ride completion, it may still be considered driver responsibility if related to the ride period.
- The driver cannot deny responsibility only because the issue was reported after ride completion if evidence supports the claim.
- Otoddy may contact the driver for clarification, recovery, verification and further action during this period.
27.5 Guilty Finding, Ban & Recovery
- If investigation, client confirmation, evidence review or legal inquiry finds the driver responsible, Otoddy may take strict action without further notice.
- Action may include temporary/permanent ban, blocking future rides, holding/deducting payouts, recovery of harzana/penalty/repair/replacement cost, reporting to client/vendor/authority/law enforcement, or filing police/legal recovery case.
27.6 Legal Action Clause
- For theft, fraud, cheating, criminal breach of trust, intentional damage, fake identity, document misuse or unlawful activity, Otoddy may initiate legal action under Indian laws.
- Otoddy may file FIR, police complaint, civil recovery case, criminal complaint or other legal proceedings.
- Legal expenses and related recovery costs may be recovered from the driver if found responsible.
27.7 Unauthorized Vehicle Usage
- The driver must not use the assigned vehicle for personal work, personal travel, unauthorized stops, commercial activity, illegal activity or any purpose outside the assigned ride.
- Unauthorized passengers, friends, relatives, goods, luggage or third-party material are strictly prohibited.
- Route deviation, unnecessary halts or movement outside assigned route without approval may lead to penalty, payout hold, investigation and ban.
27.8 Vehicle Condition Verification
- The driver must verify vehicle condition before starting, including visible damage, scratches, fuel, tyres, dashboard warnings, documents, keys and accessories.
- The driver should capture and submit photos/videos where required.
- If pre-existing damage or missing items are not reported before starting, the vehicle may be presumed accepted in proper condition.
27.9 Accident, Damage & Emergency Reporting
- In case of accident, damage, breakdown, police stop, dispute, theft or emergency, the driver must immediately inform Otoddy and follow instructions.
- The driver must provide photos, videos, location, client confirmation, police details or required proof.
- Failure to report incidents immediately may be treated as negligence, misconduct or concealment.
27.10 Negligence, Delay & Misconduct
- The driver may face penalty/action for late arrival, rude behavior, rash driving, unsafe driving, traffic violations, misuse, delay, complaints or failure to follow instructions.
- Any challan, fine, towing, parking penalty, traffic violation or legal penalty caused by driver negligence may be recovered from the driver.
- Repeated complaints or serious misconduct may result in permanent removal.
27.11 Payment Hold, Deduction & Adjustment
- Otoddy may hold, delay, adjust or deduct driver payments in case of complaint, investigation, damage claim, theft report, client dispute, legal issue or recovery.
- Payouts may be adjusted against penalties, harzana, client claims, repairs, missing parts or legal expenses.
- Payment release depends on verification and clearance of disputes.
27.12 Security Deposit & Recovery Rights
- Any security deposit, wallet balance, pending payout or future earning may be adjusted against recoverable amounts.
- If recovery exceeds pending payout/deposit, the driver must pay the remaining amount separately.
- Non-payment may result in legal recovery action.
27.13 Identity, Documents & Verification
- The driver must provide true and valid identity proof, license, address proof, contact number and required verification documents.
- Fake documents, expired license, wrong identity, duplicate account or impersonation may result in immediate ban and legal action.
- The driver must not allow anyone else to perform the ride on their behalf.
27.14 No Escape From Responsibility
- The driver cannot avoid responsibility by claiming ignorance, third-party involvement, customer fault, parking location, mechanic involvement or verbal misunderstanding if evidence indicates negligence or custody failure.
- The driver remains responsible for the vehicle while it was under their custody or control.
27.15 Evidence & Investigation Rights
- Otoddy may rely on GPS logs, ride records, app activity, call records, client statements, photos, videos, inspection reports, invoices, police reports and other evidence.
- The driver agrees to cooperate with Otoddy, client, police, insurer or authorities during investigation.
27.16 Final Decision Rights
- Otoddy may take final operational decision regarding suspension, ban, payout hold, penalty, recovery or legal action based on facts and investigation.
- Such decision shall be taken in good faith to protect company, client, vehicle owner and service quality.
27.17 Acceptance of Driver Terms
- By registering as a driver, accepting, starting, completing or continuing to use driver-related services, the driver confirms acceptance of these B2B Driver Terms & Responsibilities.
- These terms remain binding along with the main Terms & Conditions, Privacy Policy, platform rules and any additional driver agreement issued by Otoddy.
